Rental History
Each applicant may demonstrate a history of meeting prior lease or mortgage obligations and leaving any prior rented properties in good order. Significant adverse rental history may result in denial or adverse action. Significant adverse rental history includes, action to recover possession from the applicant within the last 3 years in which the action resulted in judgment for possession in favor of the housing provider. Additional adverse rental history includes allegations of a breach of lease by the applicant if the alleged breach was filed 3 or more years ago and/or did not stem from an incident that the applicant demonstrates may constitute a defense to an action for possession under § 42-3505.01(c-1) or a federal law pertaining to domestic violence, dating violence, assault, or stalking, including records of civil or criminal protection orders sought or obtained by the applicant or of criminal matters in which the applicant is a witness. Or if the alleged breach did not stem from an incident in which the applicant was a victim of a crime in the unit subject to the lease, related to the applicant's or household member's disability. Applicant must provide at least two verifiable housing provider references. Unfavorable or unverifiable references may result in denial or adverse action.
Income History
Each applicant's monthly income must be at least 3 times the monthly rent. The source and demonstrated history of the monthly income must be verifiable. Each applicant must provide objective proof of income (e.g., two pay stubs, tax returns, IRS transcript, subsidy assistance, or bank statements for the previous 90 days). Additionally, each applicant must provide at least one verifiable employer reference. Unfavorable or unverifiable references or insufficient income may result in denial or adverse action.
Credit History
Each applicant must provide the housing provider with the necessary information (e.g. name, address, SSN, date of birth, etc.) and written consent required to obtain a credit or consumer report. The name and contact information of the credit or consumer reporting agency will be provided upon receipt of applicant information. Each applicant has a right to obtain a free copy of the credit or consumer report in the event of a denial or other adverse action. The housing provider will not base an adverse action solely on a applicant's credit score or lack thereof, although information within a credit or consumer report directly relevant to fitness as a tenant may be relied upon.
Criminal History
Each applicant must provide the housing provider with the necessary information and written consent to conduct a criminal background check, if the housing provider offers a written notice of a conditional offer of housing. Unfavorable or unverifiable criminal history may result in denial or adverse action.
Application Fee
A mandatory $50 application fee is required for processing each applicant's application and obtaining and verifying each applicant's history. Each applicant is entitled to a refund of an unused portion of the application fees after a determination has been made. The housing provider may charge additional application fees if more than one screening is required.
Application Determination
Application determinations will be made within 60 days. Each applicant has a right to dispute any information relied upon by the housing provider that is inaccurately or incorrectly attributed to the prospective tenant or is based upon the housing provider's use of prohibited criteria, and the right to receive a response from the housing provider regarding any information disputed by the applicant. Each applicant has a right to file a complaint with the Office of Human Rights or pursue civil action via the Superior Court of the District of Columbia ("Superior Court") if they believe the housing provider has violated section 42-3505.10.
